FTC Joins Consumer Financial Protection Bureau in Credit Information Appeal

The case involves how disputed credit information should be handled under the Fair Credit Reporting Act.

The Consumer Financial Protection Bureau (CFPB) was joined by the Federal Trade Commission (FTC) in filing an amicus brief before the Second Circuit U.S. Court of Appeals. The federal agencies seek to have a district court’s decision reversed, saying that the lower court did not consider the Fair Credit Reporting Act requirement that a furnisher of credit information must delete what cannot be verified after consumers dispute that information.

The FTC stated, “Inaccurate information on a consumer report can hamper people’s ability to get housing, employment, and credit. The FTC and CFPB maintain that the lower court’s decision could impact consumers’ rights under the FCRA to dispute the completeness or accuracy of information and have it removed if a furnisher cannot verify that it is accurate.“
